Law week
Our week started with teacher Marjaana Marmo's lecture about different laws and rules. It is important to know how the various laws affecting, if making business internationally and conclusion of agreements. The law is also very useful to know in order to know the rights of life. The teacher taught us how the law operates in Finland, but also mentioned the laws of different countries. We also had a task to do in teams before thursday so we can understand better how law works and what does it even mean in different contents. There is a legal order which means there are national rules you have to follow in a society. Yet to live in a civil society, we must have some rules to follow. Certain things such as stealing and murdering are not correct. as we all know, but it has to be written in law so that the matter really exists. In order for the rule of law to work effectively, citizens must have a realistic ability to enforce their rights. The simplest the law tells us what is right and what is unacceptable. We have laws to help provide for our general safety. For example in every country we have speed limits so that we drive in a safe manner. Likewise, we must not steal from another. I think these thing are obvious and they should come from deep within education. I must admit that as a child I have stolen candies from store. I'm certainly not the only one. As a child, we try and learn the limits of what is right. However, the main function of law is to protect our rights. The laws are the same for everyone, so it is all right to know and to feel, how the laws are applied. In Finland, for example, everyone has the right to equal treatment. No one shall be treated differently by gender, age, religion or disability. Finland is known for equality. We are all equally valuable and I think it is an important thing to understand. I found a lot of usefull information from a website of "infobank" which is widely multiplied to our Finnish laws. In Finland, there are a lot of different topics related to the law. In addition to the laws of Finland, we must also comply with European Union law.
Main Legal Families in the world
There are three kinds of laws that exist in different countries across the world. One of them is called Code Law affecting in Germany, Japan, and a handful of other countries and we also follow it in Finland. The law is written and agreed in advance. Code law is basically a systematic list of laws that have been codified and are enforceable by law. The code law systems have been around since the Ancient times, with majority of countries usually following the code law systems, says my sources. So we follow the prior written law, this is the most important thing to understand.
Then there are Common Law in countries such as the United States, Australia, India, and Singapore and the law is followed by nominally decide individual cases but that in addition have precedential effect on future cases. Code law is basically a systematic list of laws that have been codified and are enforceable by law. So first legal precedents are set by judges deciding specific cases, and only later incorporated into legislation. I have looked at the different sources of the matter and wikipedia says that in cases where the parties disagree on what the law is, a common law court looks to past precedential decisions of relevant courts. So whenever the law is interpreted, it is considered in the previous cases, the basis of which a final decision. This is how I understand it. In a common law country, lawyers make presentations to the judge (and sometimes the jury) and examine witnesses themselves. If there is a dispute between laws, the authority or precedent looks to past cases and must provide the same reasoning and decision that was provided in the first case. I alsofound a page where they say the most developed capital markets are in countries where English-style common law holds sway. The author therefore explains the common law to support the best commerce.
The third law is Islamic law which is based on the Koran. This system is based on religious teachings, as they are enshrined in the religious scriptures. Islamic law is based on the Quran and on interpretation of the practices and sayings of Prophet Mohammad. Legislation, therefore, comes directly from the Koran. Shaykh Kabbani writes about this topic on the web page with the headline of Understanding Islamic Law. Kabbani says establishes the criteria by which all social actions are classified, categorized and administered within the overall governance of the state. It is based on morality rather than commercial requirement of human behaviour and I think it is interesting, how do you can judge people based on religion, because faith can be interpreted in different ways. The question arises suitability of this kind of law to the global world.


Law system in Finland
Finland operates in addition with Code Law, also with three other laws including Community Law, of course mainly we follow our Finnish National Law and also there is International Law. So because Finland is part of EU so we have Community Law and we follow the recommendations of the EU level called The European Convention on Human Rights. There is a list of the rules where is clearly listed the rights and all the EU countries must comply with these rules. For example article 2, Freedom of movement says: "Everyone shall be free to leave any country, including his own." So these are to the Conventionfor the Protection of Human Rights and Fundamental Freedoms securing certain rights and freedoms other than those already included in the Convention.
In addition, we follow in Finland a Community Law (supranational law) which is a legal system that generates rights and obligations for all of us in Europe. The law of the European Union as established by treaties and cases of the EU courts. Community law enables European citizens to rely directly on rules of European Union law before their national courts. This law is based on the limitation of the rights of sovereign nations between one another. My sources says that The executive force of community law cannot vary from one state to another in deference to subsequent domestic laws, without jeopardizing the attainment of the objectives of the treaty. So it means all EU members first precedence community law whereby a regulation shall be binding and directly applicable in all member states. At times it is difficult to understand how all these different laws work in practice, but are directly applicable in Finland. So in addition to the Finnish law will follow the EU law. EU has adopted, or is planning to adopt, a large number of rules to settle all these questions. Every action taken by the EU is founded on treaties.
Then we can focus on Finnish Law. Perhaps the easiest thing to understand. Pretty much useful information is written on webpage about how the finnish law system works and everything that it involves. It says the Constitution contains the basis for the functioning of society in terms of the legal relations important. It includes such configurations, fundamental human rights, the state and the citizens, as well as relations between the main public bodies on the division of power. Finnish legal system is based on four levels of legislation: Constitution,normal laws, settings, official regulations. Legislation can be found, among other things, Constitution where it says the fundamental rights, 6 § parity law "People are equal in interpreting the law". So we all have the same right and Finland is indeed egalitarian country. I feel a great happiness for personally, how well things are set in Finland and how everyone can live a dignified life. We also have legislation concerning working life which says the employer must promote equality in their employees and not to discriminate against employees or job applicants. The Consumer Protection Act, we have adjusted how business is done correctly. The purpose of the guidelines is to provide guidance to companies, advice and practical information on the application of the provisions of the law. Adhering to the principle outlined, the company can ensure the survival of the lawfulness of its own activities and consumer confidence. Ombudsman monitors and supervises the companies acts.
There doesn't really exist a law of international level, but the main thing to understand it is that there are set of rules generally regarded and accepted as binding in relations between states and between nations. It includes International Law, which governs the relationship between states and international entities. It includes these legal fields: treaty law, law of sea, international criminal law, the laws of war or international humanitarian law, international human rights law, and refugee law. Countries can therefore make agreements with one another which generated an international law after agreement. So countries have made globally accepted standards of behavior which generally termed treaties. So there is not existing only one equally valid international law, because it is not even possible, told Marjaana Marmo.


We Are Done
So that's all about laws as I know so far and have learned. I'm actually surprised how much I pay attention of this topic. Especially consumer protection law on labor interest me a bit more. I want to know and feel better, how the legislation works in work life, so that I know in the future I'm treated properly. Also it's nice to counsel others and have a valid professional knowledge. So why not to study even more about this! Anyway my week is done by now with the school. Its thursday and I don't even remember when I was home last time this early at 8pm. And at school we performed the law week home tasks as well with the team. Me and my dearest class friend ALISON stayed at school till 4pm to study a bit online courses. Im proud of us. After school my mother had a violin presentation so I was watching and listening that beautiful classical music. Then I went to my workplace having a dinner. (Do i really have that nice work to go on my day off?!?! just wondering...) Anyway cheerfully I wish everyone a good weekend! Write your post on time, so you can focus for the work rest of the week like me. Yes. Nothing new. Im gonna work long days rest of the month as I have some travel plans. Work hard, Dream big.
